Reviews of decisions made under the Motor Vehicles Act 1959

From 4 May 2020, SACAT will receive review jurisdiction under the Motor Vehicles Act 1959. This will enable SACAT to review certain decisions made by the Registrar of Motor Vehicles or a local council regarding motor vehicles. 

Types of Decisions that can be reviewed by SACAT

The Tribunal has the power to review the following decisions:

  • A decision of the Registrar of Motor Vehicles relating to the registration of motor vehicles
  • A decision of the Registrar of Motor Vehicles relating to drivers licences
  • A decision of the Registrar of Motor Vehicles relating to towtrucks
  • A decision of the Registrar of Motor Vehicles relating to disabled persons’ parking permits
  • A decision of a council to refuse to make a disability parking arrangement near a place of employment, or to revoke or vary such an arrangement

Applications of this kind will be handled by SACAT’s Administrative & Disciplinary Stream.

Time Limits

Decisions made by the Registrar of Motor Vehicles

An application for review must be made to the Tribunal within 28 days of the making of the decision.

If the reasons of the Registrar are not given in writing at the time of making the decision that is to be the subject of a review and the person seeking the review, within 1 month of the making of the decision, requires the Registrar's reasons in writing, the time for applying for a review runs from the time when the person receives 15 the written statement of those reasons.

Decisions made by a Local Council

An application for review must be made to the Tribunal within 28 days of the making of the decision.

If the reasons of the council are not given in writing at the time of making the decision that is to be the subject of a review and the person seeking the review, within 1 month of the making of the decision, requires the council's reasons in writing, the time for applying for a review runs from the time when the person receives the written statement of those reasons.

Before applying to SACAT for a review of a decision by the Director you must:

  1. Have a copy of the decision which you want to review – you should include this with your application.
  2. Ensure you are ready to pay the required fee for making an application.

You must upload a copy of the decision you are seeking to review when completing your on-line application, or you can email the decision to SACAT at sacat@sacat.sa.gov.au, or post the decision to SACAT at GPO Box 2361 Adelaide SA 5001. Please quote your tracking code or file number when sending any correspondence to SACAT.

Fees:

There is a filing fee applicable for this type of application. Payment can be made on-line by credit card at the time of completing the on-line form, or by using one of the other options outlined in the payment section of the on-line form.
