You cannot apply directly to SACAT to resolve an equal opportunity complaint.

You must first apply to the Commissioner for Equal Opportunity.

You can apply directly to SACAT in the following circumstances:

• When you have made a complaint to the Equal Opportunity Commissioner which is out of time and the Commissioner has refused to grant you an extension of time
• When you want to apply for an exemption from compliance with the Equal Opportunity Act

The Commissioner for Equal Opportunity can refer your complaint to SACAT when they:

• Have tried to conciliate the matter and been unsuccessful
• Are of the view that the matter cannot be resolved by conciliation
• Decline to recognise the complaint, and you have requested they refer it to SACAT
• Are of the opinion the matter should be transferred to SACAT
