You can apply directly to SACAT in the following circumstances:

The Commissioner for Equal Opportunity can refer your complaint to SACAT when they:

  • Have tried to conciliate the matter and been unsuccessful
  • Are of the view that the matter cannot be resolved by conciliation
  • Decline to recognise the complaint, and you have requested they refer it to SACAT
  • Are of the opinion the matter should be transferred to SACAT
